HARMAN TECHNOLOGY LIMITED – TERMS AND CONDITIONS OF SALE

Welcome to Harman Lab.

Where you place an order via our website, these terms and conditions will apply to that order in addition to the general website terms of use and privacy policy. You should therefore read these terms carefully before you place your order as they explain your and our legal rights and also contain important information about our contract with you and how your order will be dealt with.

You should print a copy of these terms for future reference.

  1. ABOUT US
    1.1 We are HARMAN technology Limited trading as Harman Lab, a company registered in England and Wales.
    1.2 Our company number is 05227615 and our VAT number is 855619102.
    1.3 Our registered office address is Whittington Hall, Whittington Road, Worcester, Worcestershire, England, WR5 2ZX, but if you would like to contact us, for example if you have any questions about your order, you should write to us at HARMAN technology Limited, Ilford Way, Mobberley, Knutsford, Cheshire, WA16 7JL.

  2. ABOUT YOU
    2.1 Please make sure that the details that you provide to us about yourself are complete and accurate.
    2.2 Unless you tell us otherwise, we will assume that you are purchasing the products for your own use. If you are purchasing on behalf of someone else, please be aware that our agreement will still be with you and you will be responsible for complying with the obligations set out in these terms and conditions, including payment obligations.
    2.3 All accounts on our website must be created in the name of an individual (not in the name of a company) and we will consider any purchase to be made by the individual in whose name the account is registered.
    2.4 You may purchase lab services from us for either business or personal use.
    2.5 We refer to customers who are purchasing lab services for personal use as “consumers”. You are considered to be a consumer if you are purchasing the lab services for personal / non-commercial purposes (purposes wholly or mainly outside your trade, business, craft or profession).
    2.6 If you are not a consumer as described in paragraph 2.5 you will be considered to be a business customer.
    2.7 If we need to contact you about your order, we will usually do this by email, using the email address associated with your account. We may also contact you by phone or by post, again using the details associated with your account.
    2.8 Before you place your order, please make sure that all of your details are correct. If any of your details change after you place your order you should let us know straight away so that we can continue to get in touch with you if we need to.
  3. PLACING AN ORDER
    3.1 You can place an order on our website by selecting the services that you want to order and proceeding to the checkout and then following the on-screen process. You may also download a printable order form and post this to us.
    3.2 Once you place an order on the website or post an order in to us, you will receive an automated email confirming receipt of your order. If you do not receive this within 24 hours of placing your order online, or within 5 working days of posting your order please check your spam filter. If you are still unable to locate the email please contact us by sending an email to the email address specified in paragraph 1.4 to check that we have received your order.
    3.3 Provided that we are able to accept your order (see paragraph 8.2 for more information about circumstances in which we cannot accept an order) we will dispatch the order as described in paragraph 6 and will send you an email to confirm this. Our email confirming dispatch constitutes acceptance of your order and will form a legally binding contract between us and you for the sale of the products, governed by these terms.
  4. OUR SERVICES
    4.1 Before placing an order, please read the description carefully to ensure that it meets your requirements. If you have any questions, let us know.
    4.2 Any packaging shown is for illustration purposes only and the packaging of the product you receive may be different.
    4.3 If you are a consumer, any warranty or guarantee provided with a product is in addition to and not in place of your rights under these terms and your other legal rights. See paragraph 9 for more information.
  5. PRICE AND PAYMENT
    5.1 The price of our services (which includes VAT) is shown on the website, and the total price that you will pay will be shown during the order process.
    5.2 We take all reasonable care to ensure that the price of the services indicated to you is correct. If we identify an error before we accept your order then we may decline to accept your order as described in paragraph 9.2, in which case you will be entitled to submit a further order at the correct price.
    5.3 We accept payment by credit or debit card. We will take payment when you place your order. If we are unable to take payment for any reason we will contact you and ask you to make payment by an alternative method. We will not be able to dispatch the order until cleared payment is received.
  6. DELIVERY
    6.1 We will deliver your product(s) to the delivery address that you have provided. If you are unavailable to accept the delivery, depending upon the shipping service it may be returned to the local sorting office or a redelivery attempted. In either case a notification will be posted through.
    6.2 The delivery costs that you will have to pay will be shown during the order process. By placing an order, you are agreeing to pay these in addition to the price of the product(s).
    6.3 If we are able to accept your order, we will print and dispatch the order promptly following receipt of your order. The estimated time period for completion of your order will vary depending upon seasonality and busy periods so is not guaranteed, but will generally be within 5 working days of the day that your films or digital files arrive in our lab. Digital images are normally downloaded with 1 working day of receiving the order. Where you have placed multiple orders we will usually dispatch all of them together, but we may on occasion dispatch them separately.
    6.4 Delivery time vary depending upon the service chosen and the location. Please see below for typical service times;
    UK Royal Mail 24 – 1-2 working days.
    UK UPS Courier – Next working day.
    International Airmail: Normally 5-7 working days, but may take considerably longer depending on the efficiency of your local postal service.
    6.5 Prints up to 10x12inches are shipped flat, larger prints are shipped in postal tubes.
    6.6 The goods become your property and responsibility from the point at which it is delivered to you (or to the address / place that you have asked us / our courier to deliver it to). If you are a business customer risk in the goods will pass to you at the point at which we first try to make delivery to you, whether or not you accept delivery.
  7. CANCELLATIONS / RETURNS
    7.1 Cancellation
    As the prints and products we produce are bespoke, the customer does not have the right to cancel an order once it is made (unlike other internet ordering services). However, if a mistake is made and you contact us immediately, we will do our best to cancel and refund your order.
  8. OUR RIGHTS TO REFUSE OR CANCEL YOUR ORDER
    8.1 Although we will normally be able to do so, we cannot guarantee to accept all orders placed via the website. You will receive an email confirming your order, but please be aware that this is generated automatically and does not mean that we have been able to accept your order. You should only consider your order to have been accepted once you receive an email confirming that your products have been dispatched.
    8.2 We may occasionally be unable to accept orders for various reasons, for example because  there was an error in the advertised price or description. If this is the case, we will let you know and, where possible, we will discuss other options with you, for example alternative services or products that may be available or the option of purchasing at the correct price.
  9. REFUNDS OR REPLACEMENT
    9.1. Our laboratory maintains very high standards but this service does not include extended insurance for professional users. If you choose to use our service we will take all possible care with your orders but in the unlikely event that your films, negatives or prints are damaged or lost whilst in the care of the processing laboratory, they will be replaced with an equivalent unexposed film which will be processed and / or printed free of charge. This is the limit of our liability for loss or damage, consequential or otherwise, and however caused.
    9.2 Should we make a mistake with an order and need to send additional prints, this will be rectified within 5 working days of receiving contact and posted free of charge. 
    9.3 Films of commercial or high value are not accepted unless there is written prior agreement.
  10. STORAGE OF ELECTRONIC IMAGES
    10.1 If you use our service for either film printing, scanning or digital printing then electronic copies of your images may be held on our website and local computer systems. We do not keep images indefinitely unless requested to do so. Any image files greater than six months old are deleted permanently from our systems.
  11. QUERIES, PROBLEMS OR COMPLAINTS
    11.1 Queries
    If you have any queries about the website, your order or our products, please email us at using the contact form on our website and we will do our best to help you.
    11.2 Problems
    We work hard to ensure that all of our customers are satisfied with the service and the products that they receive. In the unlikely event that you do experience a problem with your order, please let us know by emailing us using the contact form on our website.
    11.3 Complaints
    We take all complaints seriously. If we receive a complaint from you it will be reviewed by our customer care team who will respond to you within 28 days. If you are dissatisfied with this response you may request that your complaint be escalated, in which case it will be passed to a senior person in our business who will review your complaint and the initial response and provide a further response within 28 days of your request to escalate the matter.
    11.4 Online Dispute Resolution service
    If you are a consumer and we are unable to resolve your complaint you may wish to submit a complaint via the Online Dispute Resolution service (see http://ec.europa.eu/odr). This is an independent portal provided by the European Union. We are not currently a member of any Alternative Dispute Resolution (ADR) schemes, but we will consider whether ADR is an appropriate method of resolving a dispute with you if we are unable to resolve it through our complaints procedure.
    11.5 Other legal remedies
    We take our legal responsibilities very seriously and have prepared these terms and conditions in accordance with your legal rights. If you are a consumer the options described above are intended to describe or be in addition to your normal legal remedies and nothing in these terms will override or exclude any of your legal rights.
    11.6 Circumstances outside our control
    If circumstances arise which are outside our control and those circumstances mean we are unable to make delivery to you or fulfil our other obligations under these terms, we will not be responsible to you for any delay or other non-performance provided that we use all reasonable efforts to fulfil those obligations as soon as we can.
    If you are a consumer and you are unhappy with the delay you can cancel your order in accordance with paragraph 7. If you are a business customer you can cancel your order if the circumstances giving rise to the delay continue for more than one month and we remain unable to delivery your products or otherwise comply with our obligations under these terms.
  12. HOW WE MAY USE YOUR PERSONAL INFORMATION
    12.1 We will use the personal information you provide to us to supply the services and products to you, to process your payment for the services and products and to provide you with support after you have received the products.
    12.2 If you choose to receive information about our other products and services we believe may be of interest to you then we may use your personal information for these purposes. You may stop receiving these communications at any time by contacting us and letting us know that you want to unsubscribe.
    12.3 We will only give your personal information to third parties where the law either requires or allows us to do so.

  13. OTHER IMPORTANT TERMS
    13.1 Any contract formed will be between you and us. No other person shall have any rights to enforce any of its terms.
    13.2 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    13.3 These terms are governed by English law and you can bring legal proceedings in respect of any disputes arising out of or in connection with your order, including any problems with the products, in the English courts.
